Terms of Service

Welcome to Hoosells ("Hoosells," "we," "us"). These Terms of Service ("Terms") govern your use of the Hoosells website and services at hoosells.com, including the product-finder and the Snap & Sell tool (together, the "Service"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. What Hoosells does
Hoosells lets you photograph an item to (a) find nearby and online sellers of similar products, and (b) with Snap & Sell, get an estimated resale value and a ready-to-use listing draft. Identifications, prices, and listings are automated estimates for your convenience — not guarantees, appraisals, or professional advice. You are responsible for verifying anything before you rely on it.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service.
3. Your photos and content
You keep ownership of the photos and text you submit. You grant Hoosells a limited license to process that content to provide the Service (including sending images to our AI provider to identify and describe items and to generate listing text). Don't upload content you don't have the right to use, or that is unlawful.
4. Snap & Sell — estimates and listings
- Price ranges are estimates based on available market data (currently active online listings), not confirmed sold prices, and are not a promise of what your item will sell for.
- Generated listings are drafts. You are responsible for reviewing them for accuracy and for complying with the rules of any platform where you post (eBay, Depop, Poshmark, etc.).
- Hoosells is not a party to any sale you make on another platform and is not responsible for your transactions.
5. Payments
Some features (such as generating a full listing) require a one-time payment, processed by Stripe. Prices are shown before you pay. Because listing generation is a digital service delivered immediately, payments are generally non-refundable except where required by law or at our discretion. Contact us if something went wrong and we'll make it right.
6. Affiliate links
Some outbound links to online retailers are affiliate links, and Hoosells may earn a commission on qualifying purchases at no extra cost to you. As an Amazon Associate, Hoosells earns from qualifying purchases.
7. Acceptable use
Don't use the Service to list or find prohibited, illegal, counterfeit, recalled, or hazardous items, to abuse or overload the Service, to scrape it, or to break any law. We may suspend access for misuse.
8. Third-party services
The Service relies on third parties including Google (nearby places), Amazon and other retailers, eBay, Anthropic (AI), and Stripe (payments). Your use of those results and links may be subject to their own terms, and we don't control their content or availability.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, merchantability, or fitness for a particular purpose. We don't warrant that identifications, prices, sellers, or listings are correct, complete, or current.
10. Limitation of liability
To the maximum extent permitted by law, Hoosells and its operators will not be liable for any indirect, incidental, or consequential damages, or for any lost profits or lost sales, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim, or $50, whichever is greater.
11. Changes
We may update these Terms; the "last updated" date shows when. Continued use after changes means you accept them.
12. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules.
